Terms and Conditions

These Terms and Conditions govern your use of the Clark's Tree Express website located at clarkstreeexpress.com and your engagement of our tree care services. By accessing our website or scheduling any service with us, you agree to be bound by these terms. Please read them carefully before proceeding.


1. About Us

Clark's Tree Express is a family-owned tree care company that has operated in the greater Charlotte, North Carolina area since 1975. Our principal place of business is located at 6631 Olmsford Drive, Huntersville, NC 28078. We may be reached by phone at (704) 675-0344 or by email at clarkstreeexpress@gmail.com.


2. Services

Clark's Tree Express provides professional tree care services including, but not limited to, tree removal, tree trimming, tree pruning, stump grinding, lot clearing, tree cabling, tree planting, and emergency tree removal. All services are subject to a written or verbal agreement between Clark's Tree Express and the property owner or authorized agent.


We reserve the right to refuse any service request at our discretion, including situations where site conditions present safety risks that cannot be adequately mitigated, where access to the worksite is insufficient, or where work would violate applicable law or local ordinance.


3. Estimates and Pricing

Estimates provided by Clark's Tree Express, whether delivered in person, by phone, or in writing, are based on conditions observed or described at the time of the estimate. Final pricing is subject to change if conditions at the worksite differ materially from those present or represented during the estimating process.

A written estimate, when provided, constitutes our proposed scope of work and associated pricing. Work beyond the stated scope — including discovery of additional hazards, hidden root complexity, or structural conditions not visible during the estimate — may result in additional charges, which will be communicated to the customer prior to the performance of additional work wherever feasible.


Emergency service calls, after-hours work, weekend work, and holiday service are subject to premium rates, which will be disclosed at the time of scheduling or upon arrival at the worksite.


4. Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing prior to the commencement of work. Clark's Tree Express accepts cash, check, and major credit cards. For larger projects, we may require a deposit before work begins; deposit terms will be specified in the written estimate or service agreement.


Returned checks are subject to a returned check fee of $35 in addition to any bank fees incurred. Accounts not paid within 30 days of the invoice date may be subject to a late fee and may be referred to a collections agency. The customer is responsible for all reasonable costs of collection, including attorney's fees, where permitted by law.


5. Customer Responsibilities

To enable Clark's Tree Express to perform work safely and efficiently, customers agree to the following responsibilities prior to the commencement of any service.

  • Disclose the location of all underground utilities, irrigation lines, septic systems, and buried structures within or near the work area
  • Secure pets inside the home or a safely enclosed area away from the work zone for the duration of all work
  • Remove vehicles, outdoor furniture, potted plants, and other personal property from the work area or any area where debris may fall
  • Ensure that access to the worksite is clear and that any required gates, doors, or entry points are unlocked and accessible before the crew arrives
  • Obtain any permits required by local ordinance prior to the scheduled start date — Clark's Tree Express may assist with identifying permit requirements but is not responsible for obtaining permits on the customer's behalf unless expressly agreed

Failure to fulfill these responsibilities may result in delays, additional charges, or rescheduling of the work at the customer's expense.


6. Access to Property

By scheduling services with Clark's Tree Express, you grant our crew and equipment lawful access to your property for the purpose of performing the agreed scope of work. You represent that you are the property owner or have the authority to grant such access. If you are a tenant, you represent that you have obtained the necessary authorization from the property owner.


Clark's Tree Express will take reasonable care to minimize disruption to the property during service. However, some degree of ground disturbance, lawn compression from equipment, and incidental debris is inherent to tree care work. We are not responsible for normal wear to turf, landscaping, or unpaved surfaces that results from the use of equipment necessary to complete the job.


7. Limitation of Liability

Clark's Tree Express carries general liability insurance and workers' compensation coverage as required. In the event of damage to property caused by our crew during the performance of services, customers must notify us in writing within five business days of the completion of work. We will investigate reported damage and work with our insurance carrier as appropriate.


Clark's Tree Express is not liable for damage to underground utilities, irrigation systems, or buried structures that were not disclosed to us prior to work commencement. We are also not liable for damage to tree species or landscaping that results from root removal or ground disturbance that is inherent and necessary to the agreed scope of work.


In no event shall Clark's Tree Express be liable for indirect, consequential, incidental, or punitive damages arising from the performance of services or from any defect in services provided, except where such liability cannot be excluded under applicable North Carolina law.


Our total liability for any claim arising from services performed shall not exceed the total amount paid by the customer for the specific service giving rise to the claim.


8. Cancellation and Rescheduling

Customers may cancel or reschedule non-emergency appointments without charge if notice is provided at least 48 hours before the scheduled start time. Cancellations with less than 48 hours' notice may be subject to a trip charge to cover crew mobilization costs. Emergency service calls that are cancelled after dispatch may be subject to a response fee.


Clark's Tree Express reserves the right to reschedule appointments due to unsafe weather conditions, equipment malfunction, crew unavailability, or other circumstances beyond our control. We will provide as much advance notice as possible when rescheduling is necessary.


9. Disputes and Governing Law

These Terms and Conditions are governed by the laws of the State of North Carolina. Any dispute arising from or related to these terms or the services provided by Clark's Tree Express shall first be addressed through good-faith communication between the parties. If resolution cannot be reached, the dispute shall be subject to the jurisdiction of the appropriate courts of Mecklenburg County, North Carolina.


10. Changes to These Terms

Clark's Tree Express reserves the right to update or modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Continued use of our website or engagement of our services after changes are posted constitutes acceptance of the updated terms.
